2. Purpose
These General Terms and Conditions (hereinafter, “the Terms”) govern two distinct areas:
- A. Use of the toledoap.com website (hereinafter, “the Site”) by any visitor.
- B. Direct booking of tourist accommodation services through the Site’s own booking engine.
Bookings made through distribution channels (Booking, Airbnb, VRBO, Expedia and similar) are governed by the channel’s terms and conditions and by the specific terms of each accommodation, without prejudice to applicable mandatory Spanish provisions.
3. Acceptance
Use of the Site constitutes full acceptance of these Terms, the
Legal Notice, the
Privacy Policy and the
Cookie Policy. Booking a direct reservation requires express acceptance during the checkout process.
A) USE OF THE WEBSITE
4. Access to the Site
Access to the Site is free and open. Improper use of the Site may result in access being withdrawn. Users agree to:
- Use the Site lawfully and in good faith.
- Not perform actions that damage, overload or prevent the Site from functioning.
- Not introduce unlawful, false or harmful content.
- Not impersonate third parties.
- Not use the Site for their own commercial purposes without authorization.
- Respect the intellectual and industrial property of the content.
5. Intellectual and Industrial Property
All content on the Site (texts, images, videos, designs, code, databases, trademarks, logos, trade names) is the property of the Owner or third parties who have authorized its use, protected by national and international intellectual and industrial property legislation (RDL 1/1996 Intellectual Property Law; Law 17/2001 on Trademarks).Reproduction, distribution, public communication or transformation, in whole or in part, without express written authorization from the Owner or, where applicable, the holder of the corresponding rights, is expressly prohibited.Users may only view content online, make private copies for personal non-commercial use and share links to the Site without modifying the content.
6. Links to Third-Party Sites
The Site may contain links to third-party websites (distribution channels, partners, press). The Owner is not responsible for the content, policy or availability of those sites.
B) DIRECT ACCOMMODATION BOOKING
7. Nature of the Service
Imperica manages tourist accommodations in Castilla-La Mancha in accordance with
Decree 36/2018 on Tourist Rental Properties of Castilla-La Mancha and related regulations. Bookings constitute an accommodation contract between the guest (hereinafter, “the Client”) and Imperica or, where applicable, the owner of the accommodation that Imperica manages on their behalf.
8. Bookings
Bookings are made through the Site’s own booking engine. The process includes:
- Selection of accommodation, dates and number of guests.
- Identification of the lead guest (of legal age, with valid ID/passport).
- Acceptance of these Terms and the specific terms of the accommodation (description, price, specific cancellation policy).
- Payment — see section 11.
Upon confirmation, the Client receives an email with a booking summary, amounts and applicable terms.
9. Capacity and Lead Guest
- The maximum capacity of each accommodation is as indicated in its listing and cannot be exceeded under any circumstances. Overcrowding is grounds for immediate termination without refund.
- Adults and children over 2 years old count toward capacity. Infants (0-2 years) do not count toward capacity but must be declared.
- The lead guest is of legal age, identifies themselves at check-in with the document used for the booking and is responsible to Imperica for the other guests staying with them.
- From age 14, all guests must be registered in compliance with Royal Decree 933/2021 — see Privacy Policy.
10. Price
- Published prices include VAT at the applicable rate for tourist accommodations.
- The cleaning fee is calculated per stay and itemized in the summary.
- Where applicable, security deposit or guarantee: amount, method (pre-authorization, deposit) and refund period are shown in the accommodation listing.
- The published price may vary due to seasonality, occupancy, events or promotions. The price confirmed in the booking is binding.
11. Payment Methods
Direct bookings are charged through
Stripe Payments Europe Ltd (PCI DSS Level 1 certified payment processor, cardholder data tokenized — Imperica does not store full card numbers). Accepted methods:
- Visa, MasterCard and, where applicable, American Express credit and debit cards.
- Other payment methods offered by Stripe depending on the Client’s country.
The gateway applies standard anti-fraud controls (3D Secure / Strong Customer Authentication in accordance with the PSD2 Directive).
Replace references to Stripe if Imperica uses another processor (Santander POS or other).12. Cancellation Policy
The specific cancellation policy for each accommodation is published in its listing and expressly accepted during the booking process. In the absence of a specific policy, this general policy applies:
- Cancellation more than 14 days before check-in: full refund minus payment processing fees.
- Cancellation between 14 and 7 days before check-in: 50% refund of the amount.
- Cancellation less than 7 days before check-in, no-show or early departure: no refund, except in cases of documented force majeure.
Cancellations must be communicated in writing to
info@toledoap.com. Refunds are processed within a maximum of 14 calendar days via the same payment method.
13. Exclusion of Right of Withdrawal
In accordance with
Article 103.l of Royal Legislative Decree 1/2007 (TRLGDCU), the 14-day right of withdrawal
does not apply to accommodation contracts for purposes other than housing when a specific date or period of performance is provided, as is the case with Imperica’s tourist bookings.Cancellation of the booking is governed exclusively by the cancellation policy in section 12 or by the specific policy of the particular accommodation.
14. Arrival, Stay and Departure
- Check-in/check-out times: as indicated in the accommodation listing. Early or late check-in/out are subject to availability and, where applicable, a supplement.
- Property handover: via access code sent to the lead guest before arrival, unless the accommodation offers in-person reception.
- Property condition: the accommodation is delivered clean and as described. The Client must report any issues within the first few hours after arrival for documentation.
- Community living: respect the schedules and rules of the homeowners’ association (quiet hours, no parties, use of common areas).
- Pets: only allowed if expressly indicated in the accommodation listing and with the specific deposit shown.
- Smoking: prohibited inside the accommodation unless otherwise indicated in the listing. Non-compliance results in a penalty equivalent to the extra cleaning cost.
15. Damages and Client Liability
The Client is liable for material damage caused to the accommodation, furniture or equipment during their stay, as well as damage caused by guests staying with them.
- Imperica notifies the Client of damages within a reasonable time after departure.
- Damages are valued at replacement or repair cost with documented estimate.
- The security deposit is applied if applicable and, where necessary, the excess is claimed.
16. Imperica’s Liability
Imperica provides the service with the professional diligence typical of the sector. Its liability is limited to the total booking price, except in cases of willful misconduct, gross negligence or when mandatory law imposes greater liability (non-waivable Art. 1102 CC; Art. 82 GDPR toward data subjects; liability for personal injury). Imperica is not liable for:
- Acts of God or force majeure (natural disasters, sociopolitical conflicts, unforeseen administrative restrictions preventing the stay).
- Acts attributable to the Client, third parties or the distribution channels themselves when the booking was made through them.
- Indirect damages, loss of opportunity, loss of profit (except in cases of willful misconduct or gross negligence by Imperica).
17. Complaints — Internal and External Channels
Internal Channel
The Client may submit any complaint to:
Imperica acknowledges receipt and responds in writing within a reasonable time, not exceeding one month.
Complaint Forms
In accordance with
Decree 36/2018 of Castilla-La Mancha on Tourist Rental Properties and related regulations,
official complaint forms are available to the Client at each accommodation. Imperica provides the form and information on its processing upon the Client’s request.
European Online Dispute Resolution Platform (ODR)
Consumers residing in the European Union may use the European Commission’s ODR platform for complaints arising from online contracting:

In accordance with Organic Law 1/2025 on the efficiency of the Public Justice Service, the parties may attempt to resolve the dispute through civil mediation or any other ADR provided by law, without prejudice to their right to go to court.
18. Personal Data Protection
The processing of personal data of the Client and registered guests is governed by the
Privacy Policy, which forms an integral part of these Terms. It expressly includes:
- Compliance with Royal Decree 933/2021 (mandatory reporting to the Ministry of the Interior’s SES).
- Processing of WhatsApp Business messages and possible involvement of AI assistants under human supervision.
- Automated recording and transcription of calls, with prior notice announcement.
- Where applicable, image capture in common areas via video surveillance.
19. Modifications
Imperica reserves the right to modify these Terms when deemed appropriate. Modifications will take effect upon publication on the Site and will not affect already confirmed bookings regarding price, cancellation policy and essential agreed terms.
20. Applicable Law and Jurisdiction
These Terms are governed by
Spanish law. In particular:
- Royal Legislative Decree 1/2007 (TRLGDCU) for consumers.
- Civil Code and Commercial Code.
- Decree 36/2018 on Tourist Rental Properties of Castilla-La Mancha.
- Royal Decree 933/2021 on documentary registration and information in accommodations.
For the resolution of any dispute arising from these Terms, the parties submit to the
Courts and Tribunals of Toledo, with express waiver of any other jurisdiction that may correspond to them.However, when the Client has consumer or user status, they may choose between the courts of Toledo or those of their own domicile in accordance with Art. 90.2 TRLGDCU.
21. Partial Validity
The invalidity of any clause will not affect the validity of the rest, unless the invalid clause is essential to the economics of the contract.
